Terms & Conditions

1. Purpose of the contract

Patricia Nunes Photography undertakes to provide photographic and/or video coverage according to the package selected by the Client.

2. Payment

To secure the reservation of the chosen experience, the Client must pay a deposit equivalent to 50% of the total value of the contracted service.

This deposit is non-refundable, except as provided for in Clause 7 (Cancellation).

This amount is intended to compensate Patrícia Nunes Photography for the costs of reserving the date, including, but not limited to, reservation management time, logistical preparation of the session, and potential loss of other booking opportunities that could have been accepted for the same date.

By agreeing to these terms, the Client acknowledges that cancellation of the session will cause harm to Patrícia Nunes Photography, except as provided for in Clause 7.

The remaining amount will be paid on the day of the session, at the end of the session.

- Revolut

- Bank Transfer

- Credit/debit card through Stripe (fees may apply)

3. Session Location

The session location will be agreed upon by both parties.

Sessions held outside the locations included in the quoted price may be subject to additional travel costs, which must be previously budgeted.

Patrícia Nunes Photography reserves the right to change the location with at least 24 hours' notice due to unforeseen circumstances, including adverse weather conditions or unforeseen logistical issues.

4. Archive and Delivery Deadlines

Patrícia Nunes Photography is committed to delivering the final content within the deadline previously stipulated at the time of booking.

Artistic and technical quality will prevail over speed of delivery, and the deadline may be extended if justified. Patrícia Nunes Photography is committed to maintaining transparent communication so that the client always knows the status of delivery.

Digital files will be stored for 15 days after delivery. After this period, the client is solely responsible for their preservation.

In the event of loss or damage to the original materials (RAW files, photographs, and/or videos) captured during the session, which prevents delivery of the final result, Patrícia Nunes Photography undertakes to offer the Client the following solutions, excluding any other form of compensation:

- Rescheduling: Scheduling a new session, at no additional cost to the Client, on a date to be agreed upon by the parties, subject to Patrícia Nunes Photography's availability. The new session will aim to replicate, as far as possible, the conditions of the original session.

- Refund: Full refund of the amount paid by the Client for the contracted service.

Patrícia Nunes Photography's liability under this clause is limited to the solutions provided herein.

Patrícia Nunes Photography will not be liable for losses or damages resulting from force majeure events, including, but not limited to, theft, fire, or natural disasters. In these cases, the parties will agree in good faith on an equitable solution.

The Client acknowledges that exact replication of a photo/video session may not be possible due to factors such as lighting conditions, location, and subject availability.

5. Copyright and Use of Images

All copyrights to the images and videos captured belong to Patrícia Nunes Photography, pursuant to Article 165, § 1 of the Copyright and Related Rights Code.

Patrícia Nunes Photography reserves the right to use the photographs and videos captured during the session for the following purposes:

- Publication on the official website (www.patricianunes.pt) and Instagram to showcase the portfolio and services;

- Inclusion in digital promotional material (e.g., online advertisements).

The Client has the right to object, at any time and free of charge, to the use of their photographs and videos for direct marketing purposes, including publication in an online portfolio. To exercise this right, or to exercise your rights of access, rectification, deletion of content, limitation, or portability of your data, you must contact Patrícia Nunes Photography via email: patriciasfnunes@gmail.com.

Photographs and videos used for portfolio purposes will be retained for as long as Patrícia Nunes Photography maintains its online portfolio or uses promotional material, and may be removed at the Client's request.

Patrícia Nunes Photography undertakes to use only the photographs and videos strictly necessary for the purposes indicated above and to avoid publishing images that reveal sensitive data, unless strictly necessary.

The Client may freely use the submitted images and videos for personal and commercial purposes, as long as they do not alter the images (editing, filtering, or cropping that distorts the work delivered).

6. Photographic Style and Editing

By contracting the services, the Client acknowledges and accepts the photographic style of Patrícia Nunes Photography, as demonstrated on its digital channels.

The professional will have full artistic autonomy in the selection and editing of images, and additional revisions will not be included in the service.

7. Cancellation and Rescheduling

The Client may cancel the session with a refund of the deposit or reschedule it only in cases of force majeure, namely:

- Proven illness of those directly involved in the session;

- Adverse weather conditions (e.g., heavy rain).

8. Final Provisions

Any situation not covered by this document will be evaluated on a case-by-case basis by Patrícia Nunes Photography, based on common sense and mutual respect.

This contract is governed by Portuguese law, and the courts of the district where the Provider resides shall have jurisdiction to resolve any disputes.

The Customer acknowledges that he/she/they has had the opportunity to read and understand these Terms and Conditions of Service before making any purchase.
